1. Acceptance of Terms
By downloading, installing, or using Lullabyte ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
2. Description of Service
Lullabyte is a sleep sounds and music remix application that provides:
- Procedurally generated ambient sleep sounds
- Sound mixing with adjustable volumes
- A Remix Studio for transforming user-imported audio files into sleep-friendly versions
- Sleep timer with fade-out functionality
- Optional premium subscription (Lullabyte Pro)
3. User-Imported Audio & Copyright
Important: You are solely responsible for ensuring you have the legal right to import, modify, and listen to any audio files you use with the Remix Studio feature.
- Lullabyte provides tools to modify audio playback (speed, reverb, overlay sounds, etc.) for personal, private use only.
- You must own or have proper licenses for any audio files you import into the App.
- The App does not distribute, share, upload, or transmit your imported audio to any third party.
- VibeCMD LLC is not responsible for any copyright infringement resulting from your use of the Remix Studio feature.
- You agree not to use the App to create derivative works for public distribution or commercial purposes unless you hold appropriate rights.
4. Subscriptions & Payments
- Lullabyte offers a free tier with limited sounds and a premium tier (Lullabyte Pro) with full access.
- Subscriptions are available as weekly ($2.99), monthly ($7.99), or yearly ($29.99) auto-renewable plans.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- You can manage or cancel subscriptions in your device's Settings → Apple ID → Subscriptions.
- Free trial periods, if offered, will convert to a paid subscription unless canceled before the trial ends.
5. Intellectual Property
- All procedurally generated audio, the Lullabyte user interface, branding, and code are the property of VibeCMD LLC.
- You may not copy, modify, distribute, or reverse-engineer the App.
- The "Lullabyte" name, logo, and design are trademarks of VibeCMD LLC.
6. Disclaimer
Lullabyte is provided "as is" without warranty of any kind. VibeCMD LLC does not guarantee that the App will improve sleep quality or treat any medical condition. The App is not a medical device and should not be used as a substitute for professional medical advice.
7. Limitation of Liability
To the maximum extent permitted by law, VibeCMD LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
8. Termination
We reserve the right to suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time.
9. Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms.
